These Terms & Conditions ("Terms") govern your use of vmgtrimarans.com (the "Site"), operated by VMG Trimarans LLC, based in Deer Park, New York ("VMG Trimarans," "we," "us," or "our"). By

accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.



1. Who We Are


VMG Trimarans LLC designs and builds custovm trimaran vessels. The Site provides information about our boats, editions, and configurations, and lets you request a quote, book a call, view a

virtual tour, or use our configurator tool.



2. Use of the Site


You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable law or regulation;

  • Attempt to gain unauthorized access to the Site, our systems, or related networks;

  • Interfere with or disrupt the Site's operation, including through malicious code or automated scraping; or

  • Misrepresent your identity or affiliation when submitting a form or booking a call.

3. Intellectual Property


All content on the Site — including text, images, renderings, videos, logos, and the VMG Trimarans name and branding — is owned by VMG Trimarans LLC or its licensors and is protected by

copyright, trademark, and other intellectual property laws. You may view and share content from the Site for personal, non-commercial purposes, but you may not reproduce, modify,

distribute, or create derivative works from Site content without our prior written permission.



4. Product Information, Pricing & Renderings


We make reasonable efforts to keep the information on the Site accurate, but:

  • Boat specifications, features, dimensions, materials, and availability are subject to change without notice, including as a result of ongoing design development on custom builds.

  • Pricing shown or discussed on the Site (if any) is indicative only and does not constitute a binding offer. Final pricing is confirmed in a separate written quote or purchase agreement.

  • Images, renderings, and configurator outputs are representations for illustrative purposes and may differ from the final, as-built vessel.



5. Inquiries, Quotes & Orders


Submitting the contact form, requesting a quote, or using the configurator is an inquiry only — it is not an order and does not create a binding contract between you and VMG Trimarans LLC.

Any purchase, deposit, build slot reservation, or order is governed exclusively by a separate, signed purchase agreement negotiated directly with VMG Trimarans, and these Terms do not

modify or supersede the terms of that agreement. No payments or deposits are collected through the Site itself.



6. Third-Party Tools


The Site incorporates or links to third-party tools, including a virtual tour (Kuula), a configurator, and a scheduling tool (Notion). These tools are provided by third parties, and your use of

them is subject to those providers' own terms and policies. We are not responsible for the availability, accuracy, or performance of third-party tools.



7. Disclaimer of Warranties


The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a

particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Nothing in this Section limits any warranty that may separately apply to

a purchased vessel under a signed purchase agreement.



8. Limitation of Liability


To the fullest extent permitted by law, VMG Trimarans LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or

any loss of profits or revenues, arising out of or relating to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim arising from your use of the

Site will not exceed one hundred U.S. dollars ($100).



9. Indemnification


You agree to indemnify and hold harmless VMG Trimarans LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these

Terms or your misuse of the Site.



10. Governing Law & Dispute Resolution


These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site will be subject to

the exclusive jurisdiction of the state and federal courts located in New York.



11. Changes to These Terms


We may revise these Terms at any time by posting an updated version on this page with a new effective date. Your continued use of the Site after changes take effect constitutes

acceptance of the revised Terms.



12. Sever ability


If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
